Unlike many other countries, there are no “national holidays” in the United States because Congress only has constitutional authority to create holidays for. The 2021 Holiday Schedule is issued under the provisions of Chapter 11 of the State of Maine Civil Service Rules and the Benefit Package for Confidential. This page contains a national calendar of all 2021 federal and state holidays for the United States. These dates may be modified as official changes are.

Sept. 30, National Day for Truth and Reconciliation will not be a statutory holiday

The National Day for Truth and Reconciliation will not be a provincial statutory holiday in Ontario, Doug Ford’s government confirmed.

In June, the House of Commons unanimously supported the legislation, giving all federal employees and workers the Sept. 30 statutory holiday in federally regulated workplaces.

The day is meant to serve as a day of reflection so people can recognize the harmful legacy of the residential school system in Canada. The decision responds to the 80th call to action in the Truth and Reconciliation Commission report.

However, in a statement from the office of Indigenous Affairs Minister Greg Rickford, Ontario is working in collaboration with Indigenous partners, survivors and affected families to ensure the respectful commemoration of this day within the province, similar to Remembrance Day.

“While the National Day for Truth and Reconciliation is not a provincial public holiday this year, employers and employees may agree to treat this day as such, and some may be required to do so if it has been negotiated into collective agreements or employment contracts,” the statement says.

This means that only federally regulated businesses and organizations are required to give employees the day off. The decision not to mark Sept. 30 as a statutory holiday means that schools in Ontario will remain open.

Despite Ontario not making Sept. 30 a statutory holiday, some provinces and territories, including British Columbia, Manitoba, Nova Scotia, and the Northwest Territories, are observing the federal holiday.

Ontario currently recognizes nine public holidays, which include New Year’s Day, Family Day, Good Friday, Victoria Day, Canada Day, Labour Day, Thanksgiving Day, Christmas Day, and Boxing Day.

Bond market and bank holidays differ

Bond traders follow a more expansive holiday calendar under guidelines set by the Securities Industry and Financial Markets Association (SIFMA), a trade group that represents securities firms, banks and asset management companies.

In 2021, U.S. bond markets close on eight of the nine days the stock exchanges are silent. (The exception is Good Friday.) They also close on Columbus Day and Veterans Day.

The bond markets close early on six occasions: at 12 p.m. ET on Good Friday and at 2 p.m. ET on the Friday before Memorial Day, the Friday before Independence Day, Black Friday, Christmas Eve and New Year's Eve.

The stock market calendar also differs from the Federal Reserve System holiday schedule followed by most U.S. banks. The Fed observes Columbus Day and Veterans Day, does not take Good Friday off and does not have any formally scheduled early closing days.

Stock exchanges rarely sleep for long

Except in rare circumstances, three-day holiday weekends are the longest time the stock market goes quiet. The exchanges have closed for more than three days running only a handful of times in the past century, most recently during Superstorm Sandy in 2012 and after the 9/11 attacks in 2001.

The three-day limit is not a formal policy, but rather a rule of thumb that prevents “investor angst” from building up during an extended down period and creating volatility when the market reopens, says Sam Stovall, chief investment strategist at the investment research firm CFRA.

"There's an old saying that bull markets take the escalator while bear markets take the elevator,” Stovall says. “Since fear is a greater motivator than greed, I think investors don't want to be denied access to their money for too long. Otherwise they end up taking money off the table, especially if some unnerving event occurred while the exchange was closed."

Public HolidaysA special feature goes back to President Richard Nixon in 1971, who during his term in office moved most national holidays to the nearest Monday. Thus, a public holiday is also a day off work for large parts of the population. This does not, of course, include anniversaries such as Independence Day, New Year's Day or Christmas, which by their nature cannot be celebrated on other days. Despite the dates set by the federal government, the individual U.S. states have wide-ranging freedom in scheduling. Each state can arbitrarily move a holiday for its territory or even skip it altogether. For example, President's Day is not celebrated in 11 states. Columbus Day is also celebrated in only 34 states. In addition, there are countless dates for regional holidays.

Independence Day

Probably the best known U.S. holiday from numerous movies is Independence Day on July 4. This day dates back to 1776, when the Declaration of Independence was signed. In it, the name "United States of America" was also recorded for the first time, to which the previous 13 British colonies united. The USA did not receive its legal existence until about 12 years later with the adoption of the Constitution. Nevertheless, 1776 is considered the year of its founding. Today, the day is celebrated throughout the country with picnics, parades and fireworks. In many places, things are much more patriotic than in Europe, for example. Countless U.S. flags bathe entire streets in a sea of white, red and blue.

Thanksgiving

While in most parts of the world the Thanksgiving holiday is celebrated almost exclusively in rural areas, in the USA there is a real hustle and bustle on the fourth Thursday in November. Originally proclaimed by George Washington in 1789, the holiday was still celebrated on October 3 until 1862. It was not until Abraham Lincoln that Thanksgiving Day was moved to the day at the end of November. The reason for this move was purely economic: the additional bridging day on the following Friday and the extended weekend at the beginning of the Christmas season were intended to boost sales. As a result, the day known today as Black Friday came into being, on which retailers overflowed with discounts.

What are federal holidays in the U.S.? 

Federal holidays are holidays observed by the U.S. government. While a majority of government offices are closed on these days, small business owners and other private employers have the option of staying open. Businesses that close on federal holidays are not required to pay their employees for the day off, and those that stay open are not obligated to pay employees extra for normal work hours. In general, holidays are considered regular workdays and employees receive their normal pay for time worked. If the federal holiday falls on a weekend, it is generally observed on the closest weekday.

The U.S. government lists these days as federal holidays: 

  • New Year’s Day
  • Birthday of Martin Luther King, Jr.
  • Washington’s Birthday (also known as Presidents Day)
  • Memorial Day
  • Juneteenth National Independence Day
  • Independence Day
  • Labor Day
  • Columbus Day (or Indigenous Peoples’ Day)
  • Veterans Day
  • Thanksgiving Day
  • Christmas Day

What are paid holidays? 

Paid holidays are not required in the United States, however some employers may decide to provide compensation to their employees as a matter of policy, as laid out in an employment contract or employee handbook. In addition to the federal holidays listed above, other paid holidays might also include: 

  • Good Friday
  • Easter
  • The Friday after Thanksgiving
  • Christmas Eve
  • The day after Christmas (also known as Boxing Day)
  • New Year’s Eve
  • Other commemorative holidays like César Chávez Day

Ultimately, paid holidays are up to each employer to define. If you have questions about documenting your holiday policy, ask a lawyer. 

Do I have to allow time off for religious holidays? 

If multiple employees request time off in observance of a religious holiday, an employer must accommodate such requests in a consistent and nondiscriminatory fashion. As stated by the Equal Employment Opportunity Commision (EEOC), an employer is not required to accommodate all requests if the requests will bring hardships to the company. 

What is holiday pay? 

Under federal law, a holiday doesn’t have a special designation for overtime pay, nor is working on a holiday considered overtime. Federal law views holidays as just another business day. That said, both federal and state law requires most employers, but not all, to pay overtime to employees whose hours meet the criteria. This is important if you hold special extended hours during the holiday season, or if you rely on employees to cover additional shifts.

How much is holiday pay?

If your employees are entitled to overtime, calculating pay can be a bit tricky. The important thing to know is that under federal law, overtime is calculated weekly. This means if your employee works over 40 hours during the week of typical paid holidays like Thanksgiving, Christmas, or New Year’s Day, they are entitled to “time and a half” for the hours worked over 40 hours.

In California and a few other states, there’s also a daily overtime standard. If your employee works over eight hours on any given day, they are entitled to “time and a half” for every hour worked over eight hours. Let’s say you are a California business and your employee worked 10 hours on Christmas Day. State law requires you pay your employee overtime for 2 hours.

As an incentive, some employers may opt to offer double-time to employees working on holidays, meaning that their regular rate is multiplied by 2. While there is no federal requirement around double-time, there are double-time rules in California, which come into play if an employee works more than 12 hours in any workday or if an employee works more than seven consecutive workdays.

What is time and a half?

Time and a half pay is 50 percent more than an employee’s regular pay rate. This means for every hour of overtime an employee works, you must give them their regular pay plus half of that.

What is double-time?

Double-time pay is twice the employee’s regular rate. This means for every hour of overtime, you pay two times what the employee normally earns. 

How do I calculate time and a half?

To calculate an employee’s overtime pay for time and a half, multiply their regular rate by 1.5.

Here is a sample overtime pay calculation. In this example, the employee earns $20 per hour and has worked 4 hours of overtime for the week.

Time and a half hourly wage1.5 x $20 = $30 per hour

Regular weekly pay$20 x 40 hours = $800
Time and a half pay$30 x 4 hours = $120
Weekly pay including time and a half$800 + $120 = $920

Note that the sample calculations above are pre-tax and are examples only. Please ask a lawyer or your payroll administrator for details specific to your situation.

What about vacation pay during a holiday?

Under the Fair Labor Standards Act (FLSA), you are not obligated to pay employees for time not worked–This includes vacation days in addition to holidays. Therefore, if your employee takes a vacation day on Christmas or New Year’s Day, there is no law requiring you to pay them for the time off.

If your employee is entitled to vacation pay, it will be based on an agreement between you and the employee. Sometimes, prior to hiring, an employee will negotiate for a certain number of paid vacation days. While individual agreements should be recorded in an employment contract, the best place to document your company’s rules is your employee handbook or in a separate vacation policy.

General holidays are sometimes referred to as statutory holidays or stat holidays. They are days recognized by law as holidays. Employees either have this day off with pay, or are paid differently if they work.





What are the general holidays in Manitoba?

There are eight general holidays throughout the year:

Are Easter Sunday, Terry Fox Day, National Day of Truth and Reconciliation (September 30th), Remembrance Day and Boxing Day general holidays?

Employees who do not work on Easter Sunday, Terry Fox Day, National Day of Truth and Reconciliation, and Boxing Day do not have to be paid because these are not general holidays.
       
Although Remembrance Day is not a general holiday, there are restrictions for operating businesses and special requirements for paying employees who work that day. See the Remembrance Day fact sheet for more details.


How is general holiday pay calculated?

Employees who consistently work the same number of hours get one regular work day’s pay as general holiday pay.

  • For example, an employee who always works 8 hours a day, 40 hours a week, would get their regular wages for 8 hours as general holiday pay.

For employees whose hours of work or wages vary, general holiday pay is calculated at 5% of the gross wages (not including overtime) in the 4 week period immediately before the holiday.

  • For example: an employee who works varying hours each day, and earned $1200 in the 4 weeks before the holiday, is entitled to general holiday pay of $60 ie.  $1200 ×5%=$60

Is there an exception for the construction industry?

In the construction industry employees are still entitled to general holiday pay.  Employees working in the construction industry receive 4% of their gross earnings as general holiday pay, which is often paid on every cheque instead of on the general holiday. Do all employees receive general holiday pay?

All employees receive general holiday pay unless:

  • They are scheduled to work on a general holiday, but are absent without the employer's permission.
  • They are absent without the employer's permission from their last scheduled workday before the holiday, or their first scheduled workday after the holiday.

Election officials, enumerators and any other temporary person appointed under The Elections Act are not entitled to general holiday pay.


Do employees have to work a certain length of time before they qualify for general holiday pay?

No. The length of time employees work for an employer does not affect the requirement to pay general holiday pay.

For example, if an employee started to work for the employer one day before the general holiday, the employee would be entitled to 5% of the wages earned on that day as general holiday pay.


What if employees work on the general holiday?

Employees who work on a general holiday are normally entitled to 1 ½ times their regular rate of pay for the hours worked on the day in addition to their general holiday pay.


Do all employers need to pay 1 ½ times the regular wage for work on a general holiday?

At most workplaces, employers must pay employees who work on a general holiday their general holiday pay, plus 1 ½ times their wage for the hours worked on that day.

The exception is for employers operating a gas station, hospital, hotel, restaurant, place of amusement, continuously operating business, climate-controlled agricultural business, or a seasonal industry (excluding construction), or those employing domestic workers. These employers can pay regular wages for work on the holiday if they provide another day off with general holiday pay within the next 30 days. If employers and employees agree, the day off may be taken sometime before the employees' next annual vacation. 


How is general holiday pay calculated for employees who are paid by incentive for a general holiday on which they do not work?

Like other types of pay, employees who earn incentive pay are entitled to 5% of the total wages (including incentive pay) in the 4-week period before the holiday.


How is general holiday pay calculated for employees paid by incentive if they work the general holiday?

Most employees who work on a general holiday are entitled to 1½ times their regular wage rate for hours worked on a general holiday in addition to the general holiday pay of 5% of their earnings in the four-week period before the holiday. This includes employees who are paid by incentive.

To calculate the wages to which an incentive paid employee is entitled, first calculate the hourly wage by dividing the incentive pay by the total number of hours worked in the pay period. The hourly wage usually changes in each pay period since it depends on the pay earned and the number of hours worked.

For example, in this pay period, a commission salesperson paid once a week, earns $800 commission, worked 32 hours of standard time and 8 hours on the general holiday.
 

Commissions    = Hourly Wage   or     $800     = $20/hour 
Total Hours 40

The hourly wage is then multiplied by the regular hours worked:

Hourly Wage ×Regular Hours Worked  $20 ×32=$640 

 To calculate wages for working on the general holiday, multiply the hourly wage by 1 ½ times:  

Hourly Wage ×1.5=Overtime Wage $20 ×1.5=$30

This amount is then multiplied by the number of hours worked on the general holiday. In this example, the salesperson earned:  

Wages for working on the general holiday ×Hours worked on general holiday $30 ×8=$240 

Add the regular wages and the wages for working on the general holiday together to calculate the total amount the salesperson earned during the pay period. 

 $640 +$240=$880

Since the salesperson already earned $800 in this pay period, the employer pays an additional $80 to account for the hours worked that have not yet been paid, plus the 5% of the regular earnings in the 28 days before the holiday.

 


What is incentive pay?

Incentive pay is based on how productive employees are rather than the number of hours they work. Common examples include commission salespeople, flat-rate mechanics, and pieceworkers. 


What if the general holiday is on a weekend?

When a general holiday falls on a Saturday or Sunday that an employee does not normally work, the employee must get the next regular workday off with general holiday pay.


What if the general holiday is a day the employee does not normally work?

When a general holiday falls on a weekday that the employee does not normally work, the employer must give the employee a normal workday off with general holiday pay.  This must be given before the employee's next vacation, or at another time agreed to by the employee.


Can employees and employers choose to use a different day as a general holiday?

Employers may substitute another day for a general holiday for the purposes of general holiday pay and wages for hours worked on the day:

  • Under a collective (union) agreement, or
  • With the written agreement of a majority of the employees. This does not need to be approved by Employment Standards but the employer should keep a copy of the agreement.

The substituted day must be within 12 months of the general holiday.


What if the employment ends before the alternate day off for the general holiday is taken?

If the employment ends before the day off is taken, employers must pay the holiday pay within 10 business days of the employment ending. This pay cannot be used as part of a notice period. 


What if employment ends in the four weeks before a general holiday?

If employees end the employment before a general holiday there is no entitlement to general holiday pay for that holiday.

If employers end the employment before a general holiday, employees are still entitled to general holiday pay of 5% of total wages (excluding overtime, but including wages in lieu of notice) for the four-week period immediately before the holiday. The general holiday pay must be paid with the last wages no later than 10 business days after the employment ended.


How does a general holiday affect an employee's rights to have a weekly day of rest or to get paid for overtime?

The wages paid for a general holiday are considered hours worked for the purposes of overtime and must be included when calculating employees’ hours of work.  A general holiday does not substitute for a weekly day of rest.


How do general holidays affect vacations and vacation pay?

General holidays are not counted as a vacation day. If a general holiday falls during an employee’s vacation, the employee would receive another day off with pay and general holiday wages for the day of the general holiday.   General holiday pay is included when calculating vacation wages.  For more information, see the Vacations & Vacation Pay fact sheet.


What retail businesses can be open on Sundays and general holidays?

Retail businesses are no longer required to close after 6 p.m. on Sundays and certain holidays and can set their own hours of operation. 

While provincial restrictions have been removed, municipalities have authority to pass by-laws under The Municipal Act to restrict retail businesses within their jurisdictions from operating on certain days or during specific hours. 

Remembrance Day is not a general holiday. Retail businesses cannot be open between 9:00 a.m. and 1:00 p.m. on Remembrance Day. More information is available on the Remembrance Day fact sheet.

Holiday Pay

The Fair Labor Standards Act (FLSA) does not require payment for time not worked, such as vacations or holidays (federal or otherwise). These benefits are generally a matter of agreement between an employer and an employee (or the employee's representative).

On a government contract to which the labor standards of the McNamara O'Hara Service Contract Act (SCA) apply, holiday and/or vacation fringe benefit requirements are stated in the SCA wage determinations in contracts that exceed $2,500.

On a government contract to which the labor standards of the Davis-Bacon and Related Acts apply, holiday pay and/or vacation pay is required for specific classifications of workers only if the Davis-Bacon wage determination in the covered contract specifies such requirements for workers employed in those classifications.

US federal holidays 2021: Full list from Thanksgiving to Christmas

From Independence Day to Thanksgiving, there is plenty to put in the calendars for 2021.

First introduced by Congress in 1885 when it was decided that federal employees should have certain days off from work, the list of US federal holidays eventually grew to the 10 days of historical significance that Americans now recognise.

And, to ensure that Americans get the chance to celebrate the holidays no matter what day they fall on, there are guidelines for celebrating.

Federal holidays that fall on a Saturday are observed by federal employees on the previous Friday, whereas holidays that fall on Sunday are observed the following Monday.

On these days, non-essential federal government offices are closed and banks, post offices and schools may also be closed.

For employees in the private sector, federal holidays may or may not mean a day off - as companies cannot legally be required to observe the holiday. Fortunately, most employers will still give employees the day off on holidays such as Thanksgiving or Christmas - or pay extra to employees working on the day.

These are the dates of the 2021 US federal holidays to mark on your calendar.

The Fair Labor Standards Act (FLSA) does not require payment for time not worked, such as vacations or holidays (federal or otherwise). These benefits are generally a matter of agreement between an employer and an employee (or the employee's representative).

Holidays are usually a time for celebration, reflection, or remembrance, but for small business owners and employees, holiday pay policy can be confusing. Here’s a brief refresher on what’s legal for holiday, overtime, and vacation pay.

What are federal holidays in the U.S.? 

Federal holidays are holidays observed by the U.S. government. While a majority of government offices are closed on these days, small business owners and other private employers have the option of staying open. Businesses that close on federal holidays are not required to pay their employees for the day off, and those that stay open are not obligated to pay employees extra for normal work hours. In general, holidays are considered regular workdays and employees receive their normal pay for time worked. If the federal holiday falls on a weekend, it is generally observed on the closest weekday.

The U.S. government lists these days as federal holidays:

  • Washington’s Birthday (also known as Presidents Day)

What are paid holidays? 

Paid holidays are not required in the United States, however some employers may decide to provide compensation to their employees as a matter of policy, as laid out in an employment contract or employee handbook. In addition to the federal holidays listed above, other paid holidays might also include: 

  • Good Friday
  • Easter
  • The Friday after Thanksgiving
  • Christmas Eve
  • The day after Christmas (also known as Boxing Day)
  • New Year’s Eve
  • Other commemorative holidays like César Chávez Day

Do I have to allow time off for religious holidays? 

If multiple employees request time off in observance of a religious holiday, an employer must accommodate such requests in a consistent and nondiscriminatory fashion. What is holiday pay? 

Under federal law, a holiday doesn’t have a special designation for overtime pay, nor is working on a holiday considered overtime. Federal law views holidays as just another business day. That said, both federal and state law requires most employers, but not all, to pay overtime to employees whose hours meet the criteria. This is important if you hold special extended hours during the holiday season, or if you rely on employees to cover additional shifts.

How much is holiday pay?

If your employees are entitled to overtime, calculating pay can be a bit tricky. The important thing to know is that under federal law, overtime is calculated weekly. This means if your employee works over 40 hours during the week of typical paid holidays like Thanksgiving, Christmas, or New Year’s Day, they are entitled to “time and a half” for the hours worked over 40 hours.

In California and a few other states, there’s also a daily overtime standard. If your employee works over eight hours on any given day, they are entitled to “time and a half” for every hour worked over eight hours. Let’s say you are a California business and your employee worked 10 hours on Christmas Day. State law requires you pay your employee overtime for 2 hours.

While there is no federal requirement around double-time, there are double-time rules in California, which come into play if an employee works more than 12 hours in any workday or if an employee works more than seven consecutive workdays.

What is time and a half?

Time and a half pay is 50 percent more than an employee’s regular pay rate. This means for every hour of overtime an employee works, you must give them their regular pay plus half of that.

What is double-time?

Double-time pay is twice the employee’s regular rate. This means for every hour of overtime, you pay two times what the employee normally earns. 

How do I calculate time and a half?

Here is a sample overtime pay calculation. In this example, the employee earns $20 per hour and has worked 4 hours of overtime for the week.

What about vacation pay during a holiday?

Under the Fair Labor Standards Act (FLSA), you are not obligated to pay employees for time not worked–This includes vacation days in addition to holidays. Therefore, if your employee takes a vacation day on Christmas or New Year’s Day, there is no law requiring you to pay them for the time off.

If your employee is entitled to vacation pay, it will be based on an agreement between you and the employee. Sometimes, prior to hiring, an employee will negotiate for a certain number of paid vacation days. While individual agreements should be recorded in an employment contract, the best place to document your company’s rules is your employee handbook or in a separate vacation policy.

There are currently eleven national public holidays in the United States designated in Title V of the United States Code (5 U.S.C. § 6103).[1] These federal holidays apply to all federal government entities. State and city holidays may be observed concurrently with federal holidays.

History[edit]

On June 28, 1870, Congress created federal holidays "to correspond with similar laws of States around the District . and . in bb spoilers hoh State of the Union."[2] Although at first applicable only to federal employees in the District of Columbia, Congress extended coverage in 1885 to all federal employees.

The original four holidays were:

  • New Year's Day
  • Independence Day
  • Thanksgiving Day
  • Christmas Day

George Washington's Birthday became a federal holiday in 1879. In 1888 and 1894, respectively, Decoration Day (now Memorial Day) and Labor Day were created. In 1938, Armistice Day (now Veterans Day) was created to mark the end of World War I. The scope and the name of the holiday was expanded in 1954 to honor Americans who fought in World War II and the Korean War.

In 1968, the Uniform Monday Holiday Act shifted several holidays to always fall on a Monday and saw the establishment of Columbus Day.

In 1983, Ronald Reagan signed Martin Luther King Jr. Day into law, and it was first observed three years later, although some states resisted. It was finally celebrated by all 50 states in 2000. Senators Jesse Helms of North Carolina and John McCain of Arizona opposed the creation of the federal holiday for the birthday of Martin Luther King Jr. when it was approved in the Senate 78-22 in 1983.[3]

On June 16, 2021, the U.S. Congress passed legislation to make Juneteenth (June 19) a federal holiday. The day commemorates the end of slavery in Texas in 1865. PresidentJoe Biden signed this bill into law on June 17, 2021.[4][5][6][7]

Most of the 11[8] U.S. federal holidays are also state holidays. A holiday that falls on a weekend is usually observed on the closest weekday (e.g. a holiday falling on a Saturday is observed on the preceding Friday, while a holiday falling on a Sunday is observed on the succeeding Monday).[9] The official names come from the statute that defines holidays for federal employees.

New Year's Day, Juneteenth, Independence Day, Veterans Day, and Christmas Day are observed on the same calendar date each year, irrespective of the day of the week. When a holiday falls on a Saturday, federal employees who work Monday to Friday observe the holiday on the previous Friday. Federal employees who work on Saturday observe the holiday on Saturday and, for them, Friday is a regular work day. Holidays that fall on a Sunday are observed by federal workers the following Monday. The other holidays always fall on a specific day of the week.[9]

Inauguration Day, held on January 20 every four years following a quadrennial presidential election, is considered a paid holiday for federal employees in the Washington, D.C., area by the Office of Personnel Management. However, it is not considered a federal holiday in the United States equivalent to the eleven holidays mentioned above.[16]

Although many states recognize most or all federal holidays as state holidays, the federal government cannot enact laws to compel them to do so. Furthermore, states can recognize other days as state holidays that are not federal holidays. For example, the State of Texas recognizes all federal holidays except Columbus Day, and in addition recognizes the Friday after Thanksgiving, Christmas Eve, and the day after Christmas as state holidays.[17] Furthermore, Texas does not follow the federal rule of closing either the Friday before if a holiday falls on a Saturday, or the Monday after if a holiday falls on a Sunday (offices are open on those Fridays or Mondays), but does have "partial staffing holidays" (such as March 2, which is Texas Independence Day) and "optional holidays" (such as Good Friday).[17]

Private employers also are not required to observe federal or state holidays, the key exception being federally chartered banks. Some private employers, often by a union contract, pay a differential such as time-and-a-half or double-time to employees who work on some federal holidays. However, employees not specifically covered by a union contract might only receive their standard pay for working on a federal holiday, depending on the company policy.

Proposed federal holidays[edit]

Many proposed federal holidays have come up over time. According to an article from CBS, federal holidays are generally "expensive" and they only allow federal workers to take the day off. As the U.S. federal government is a large employer, the holidays are expensive. If a holiday is controversial, opposition will generally prevent bills enacting them from passing. For example, Martin Luther King Jr. Day, marking King's birthday, took a lot of effort to pass.[18] And once it did pass, it took more effort for all states to eventually recognize it. It was not until 2000 that this holiday was officially observed in all 50 states.[19]

Controversy[edit]

South Dakota is the only state to recognize Native American Day as an alternate. Hawaii recognizes Discoverer's Day. Other states such as Maine, Nevada, Washington and Wisconsin instead recognize Indigenous Peoples' Day as an alternative holiday.

Christmas Day as a federal or public holiday is also sometimes objected to by various sources,[35][36][37] usually due to its ties with the Christian religion. In December 1999, the Western Division of the United States District Court for the Southern District of Ohio, in the case Ganulin v. United States, denied the charge that Christmas Day's federal status violated the Establishment Clause of the Constitution, ruling that "the Christmas holiday has become largely secularized", and that "by giving federal employees a paid vacation day on Christmas, the government is doing no more than recognizing the cultural significance of the holiday".[38][39]

Bond market and bank holidays differ

Bond traders follow a more expansive holiday calendar under guidelines set by the Securities Industry and Financial Markets Association (SIFMA), a trade group that represents securities firms, banks and asset management companies.

In 2021, U.S. bond markets close on eight of the nine days the stock exchanges are silent. (The exception is Good Friday.) They also close on Columbus Day and Veterans Day.

The bond markets close early on six occasions: at 12 p.m. ET on Good Friday and at 2 p.m. ET on the Friday before Memorial Day, the Friday before Independence Day, Black Friday, Christmas Eve and New Year's Eve.

The stock market calendar also differs from the Federal Reserve System holiday schedule followed by most U.S. banks. The Fed observes Columbus Day and Veterans Day, does not take Good Friday off and does not have any formally scheduled early closing days.

Stock exchanges rarely sleep for long

Except in rare circumstances, three-day holiday weekends are the longest time the stock market goes quiet. The exchanges have closed for more than three days running only a handful of times in the past century, most recently during Superstorm Sandy in 2012 and after the 9/11 attacks in 2001.

General holidays are sometimes referred to as statutory holidays or stat holidays. They are days recognized by law as holidays. Employees either have this day off with pay, or are paid differently work from home amazon jobs near me they work.





What are the general holidays in Manitoba?

There are eight general holidays throughout the year:

  • New Year's Day

Most employees are paid general holiday pay for these days whether they work or not.

Are Easter Sunday, Terry Fox Day, National Day of Truth and Reconciliation (September 30th), Remembrance Day and Boxing Day general holidays?

Employees who do not work on Easter Sunday, Terry Fox Day, National Day of Truth and Reconciliation, and Boxing Day do not have to be paid because these are not general holidays.
       
Although Remembrance Day is not a general holiday, there are restrictions for operating businesses and special requirements for paying employees who work that day. See the Remembrance Day fact sheet for more details.


How is general holiday pay calculated?

Employees who consistently work the same number of hours get one regular work day’s pay as general holiday pay.

  • For example, an employee who always works 8 hours a day, 40 hours a week, would get their regular wages for 8 hours as general holiday pay.

For employees whose hours of work or wages vary, general holiday pay is calculated at 5% of the gross wages (not including overtime) in the 4 week period immediately before the holiday.

  • For example: an employee who works varying hours each day, and earned $1200 in the 4 weeks before the holiday, is entitled to general holiday pay of $60 ie.  $1200 ×5%=$60

Is there an exception for the construction industry?

Do all employees receive general holiday pay?

Election officials, enumerators and any other temporary person appointed under The Elections Act are not entitled to general holiday pay.


Do employees have to work a certain length of time before they qualify for general holiday pay?

No. The length of time employees work for an employer does not affect the requirement to pay general holiday pay.

For example, if an employee started to work for the employer one day before the general holiday, the employee would be entitled to 5% of the wages earned on that day as general holiday pay.


What if employees work on the general holiday?

Employees who work on a general holiday are normally entitled to 1 ½ times their regular rate of pay for the hours worked on the day in addition to their general holiday pay.


Do all employers need to pay 1 ½ times the regular wage for work on a general holiday?

At most workplaces, employers must pay employees who work on a general holiday their general holiday pay, plus 1 ½ times their wage for the hours worked on that day.

The exception is for employers operating a gas station, hospital, hotel, restaurant, place of amusement, continuously operating business, climate-controlled agricultural business, or a seasonal industry (excluding construction), or those employing domestic workers. These employers can pay regular wages for work on the holiday if they provide another day off with general holiday pay within the next 30 days. If employers and employees agree, the day off may be taken sometime before the employees' next annual vacation. 


How is general holiday pay calculated for employees who are paid by incentive for a general holiday on which they do not work?

Like other types of pay, employees who earn incentive pay are entitled to 5% of the total wages (including incentive pay) in the 4-week period before the holiday.


How is general holiday pay calculated for employees paid by incentive if they work the general holiday?

Most employees who work on a general holiday are entitled to 1½ times their regular wage rate for hours worked on a general holiday in addition to the general holiday pay of 5% of their earnings in the four-week period before the holiday. This includes employees who are paid by incentive.

To calculate the wages to which an incentive paid employee is entitled, first calculate the hourly wage by dividing the incentive pay by the total number of hours worked in the pay period. The hourly wage usually changes in each pay period since it depends on the pay earned and the number of hours worked.

For example, in this pay period, a commission salesperson paid once a week, earns $800 commission, worked 32 hours of standard time and 8 hours on the general holiday.
 

Commissions    = Hourly Wage   or     $800     = $20/hour 
Total Hours 40

The hourly wage is then multiplied by the regular hours worked:

Hourly Wage ×Regular Hours Worked  $20 ×32=$640 

 To calculate wages for working on the general holiday, multiply the hourly wage by 1 ½ times:  

Hourly Wage ×1.5=Overtime Wage $20 ×1.5=$30

This amount is then multiplied by the number of hours worked on the general holiday. In this example, the salesperson earned:  

Wages for working on the general holiday ×Hours worked on general holiday $30 ×8=$240 

Add the regular wages and the wages for working on the chase credit card fraud prevention number holiday together to calculate the total amount the salesperson earned during the pay period. 

 $640 +$240=$880

Since the salesperson already earned $800 in this pay period, the employer pays an additional $80 to account for the hours worked that have not yet been paid, plus the 5% of the regular earnings in the 28 days before the holiday.

 


What is incentive pay?

Incentive pay is based on how productive employees are rather than the number of hours they work. Common examples include commission salespeople, flat-rate mechanics, and pieceworkers. 


What if the general holiday is on a weekend?

When a general holiday falls on a Saturday or Sunday that an employee does not normally work, the employee must get the next regular workday off with general holiday pay.


What if the general holiday is a day the employee does not normally work?

When a general holiday falls on a weekday that the employee does not normally work, the employer must give the employee a normal workday off with general holiday pay.  This must be given before the employee's next vacation, or at another time agreed to by the employee.


Can employees and employers choose to use a different day as a general holiday?

Employers may substitute another day for a general holiday for the purposes of general holiday pay and wages for hours worked on the day:

  • Under a collective (union) agreement, or
  • With the written agreement of a majority of the employees. This does not need to be approved by Employment Standards but the employer should keep a copy of the agreement.

The substituted day must be within 12 months of the general holiday.

The general holiday pay must be paid with the last wages no later than 10 business days after the employment ended.


How does a general holiday affect an employee's rights to have a weekly day of rest or to get paid for overtime?

What retail businesses can be open on Sundays and general holidays?

Retail businesses are no longer required to close after 6 p.m. on Sundays and certain holidays and can set their own hours of operation. 

While provincial restrictions have been removed, municipalities have authority to pass by-laws under The Municipal Act to restrict retail businesses within their jurisdictions from operating on certain days or during specific hours. 

Remembrance Day is not a general holiday. Retail businesses cannot be open between 9:00 a.m. and 1:00 p.m. on Remembrance Day. More information is available on the Remembrance Day fact sheet.
