Report: Consumer Protection

Addendum: After publication of this report, it came to our attention that the dataset we used to approximate the size of credit card companies relative to each other—‘purchase volume’—was incomplete. The dataset omitted information on certain cards that companies issue on behalf of other entities, such as the cards GE Capital Retail issues on behalf of some department stores. This omission affects several companies, and would tend to increase those companies’ complaint rates relative to companies that are less involved in such arrangements (see chart on p. 15). Although we are unable to verify this information, a representative from GE Capital has stated that a more complete figure for their total purchase volume would change their complaints per billion dollars in purchase volume from 88 to 17 or 18, placing them in the middle of the rankings rather than at the top.

The Consumer Financial Protection Bureau (CFPB) was established in 2010 in the wake of the worst financial crisis in decades. Its mission is to identify dangerous and unfair financial practices, to educate consumers about these practices, and to regulate the financial institutions that perpetuate them.

To help accomplish these goals, the CFPB has created and made available to the public the Consumer Complaint Database. The database tracks complaints made by consumers to the CFPB and how they are resolved. The Consumer Complaint Database enables the CFPB to identify financial practices that threaten to harm consumers and enables the public to evaluate both the performance of the financial industry and of the CFPB.

This is the fourth in a series of reports that review complaints to the CFPB nationally and on a state-by-state level. In this report we explore consumer complaints about credit cards with the aim of uncovering patterns in the problems consumers are experiencing with their credit cards and documenting the role of the CFPB in helping consumers successfully resolve their complaints.

Despite the benefits to consumers brought by enactment of the Credit Card Accountability Responsibility and Disclosure (Credit CARD) Act of 2009, consumer complaints about credit cards remain common. Between November 2011 – when the Consumer Financial Protection Bureau began recording data on credit cards – and September 10th, 2013, the CFPB recorded more than 25,000 complaints about credit cards.

  • Capital One was the most complained-about credit card issuer by total number of complaints, followed by Citibank, Bank of America and JPMorgan Chase.
  • GE Capital Retail was the most complained-about credit card company among the top 10 card issuers based on the ratio of complaints to card purchase volume. GE Capital Retail experienced 88 complaints per billion dollars in purchase volume, followed by Capital One with 46 complaints and Barclays with 25 complaints per billion dollars in purchase volume.
  • Ten U.S. credit card companies accounted for about 93 percent of all consumer complaints to the CFPB. (See Figure ES-1.)

Consumers face a wide array of problems with their credit cards. The most common problem faced by consumers was billing disputes, followed by difficulties with annual percentage rates (APR) or interest rates, and trouble with identity theft, fraud or embezzlement. Thousands of consumers also complained about problems with closing or canceling accounts, late fees and collection practices.

Complaints about companies vary by state, and state residents vary in their tendency to reach out to the CFPB.

  • Capital One was the most complained-about credit card company in 43 states, while Citibank was the most complained-about company in six states and the District of Columbia. Bank of America was the most complained-about company in Alaska. (See Figure ES-3.)
  • Residents of Northeastern states are most likely to complain about their credit cards, while consumers in the Midwest and South are least likely. The District of Columbia had the most complaints per capita, followed by Delaware, Maryland, New York, New Jersey, Florida, Connecticut, Massachusetts, Virginia and Maine.

The CFPB is making a significant difference for consumers facing difficulty with their credit card companies:

  • The CFPB has helped more than 7,300 consumers – about three in 10 complainants – to receive monetary compensation as a result of their credit card complaints. (See Figure ES-5.) The median amount of monetary relief for consumers with credit card complaints through mid-2013 was $128. More than 2,000 additional consumers have had their complaints closed with some form of non-monetary relief, which includes actions such as altering account terms or fixing an incorrect submission of information to a credit bureau.

  • Credit card companies vary greatly in the degree to which they respond to consumer complaints with offers of monetary relief. Nearly two out of every five complaints concerning GE Capital Retail resulted in monetary relief to the consumer, while only about 20 percent of complaints concerning American Express did.
  • About 20 percent of responses from credit card companies were deemed unsatisfactory by consumers and were subjected to further dispute.
  • Of the 10 companies with the most overall complaints, the company with the highest number of disputed responses was Capital One, with 1,044, followed by Citibank and Bank of America. (See Table ES-1.) These three credit card companies were also the three companies with the highest number of overall complaints.

  • Of the 10 companies with the most overall complaints, the company with the greatest proportion of disputed responses was American Express (Amex), with just over a quarter of responses disputed. Of these same companies, GE Capital Retail had the lowest proportion of disputed responses, at 14 percent.

The Consumer Financial Protection Bureau’s Consumer Complaint Database is a key resource for consumer protection. To enhance the ability of the CFPB to respond to consumer complaints, the CFPB should:

  • Add more detailed information to the database, such as actual complaint narratives, detailed complaint categories and subcategories, complaint resolution details, consumer dispute details, and data regarding membership in classes protected from discrimination by law. Expansion of complaint-level details should include more information about amounts and types of monetary and non-monetary relief. Software and other techniques should be used to protect consumer privacy by giving consumers the right not to provide details and by taking steps to prevent the release of personally-identifiable information or the re-identification of consumers. It is critical that the Bureau achieve the disclosure of more individual complaint details while simultaneously making every reasonable effort to protect personal data.
  • Add features such as clear definitions of terms and instructions.
  • Provide regular trend analyses and monthly detailed reports on complaint resolutions and disputes.
  • Simplify the interfaces that allow users to summarize complaint database reports in graphical and printable formats.
  • Publicize information about the CFPB complaints process in forums that are likely to be seen by credit card users. The agency should develop more outreach mechanisms for consumer education about the database and its services for consumers, including through the creation of educational materials to be distributed on- and off-line, through more events outside Washington, D.C., and through non-profit organizations.
  • Develop free applications (apps) for consumers to download to smartphones to access information about how to complain about a firm and how to review complaints in the database.
  • Expand the Consumer Complaint Database to include discrete complaint categories for high-cost credit products such as auto title loans and prepaid cards. We commend the CFPB for adding payday loan complaints to the database in November 2013.
  • Continue to use the information gathered from the Consumer Complaint Database, from supervisory and examination findings, and from other sources to require a high, uniform level of consumer protection and ensure that responsible industry players can better compete with those who are using harmful practices.

4. How The Two Sets of Features of the Secured Card Work. Secured Card accounts have two sets of features: The Secured Card features and the Store Card features. Each set of features has a different Purchase APR and Late Payment Fee as shown below and may have different rewards available.

  • The Secured Card features include a standard purchase APR of 10% and a Late Fee of $5. The Store Card features include a standard variable purchase APR of 25.99% and a Late Fee of up to $38. These APRs and fees are accurate as of 01/15/2021. The purchase APR under the Store Card features will vary with the market based on the Prime Rate (as defined in the credit card agreement).
  • Upon approval, you will only be able to access the Secured Card features. To access the Secured Card features, you will be required to provide Synchrony Bank with a security deposit, the amount of which will equal the credit limit on your account.
  • After you have been an accountholder for 12 months, Synchrony Bank will consider whether you are eligible to opt in to access the Store Card features of the account based on specific eligibility criteria and your credit profile. If you are eligible, Amazon will notify you and provide you with important information to help you decide whether to retain the Secured Card features or convert to the Store Card features. The Store Card features do not require a security deposit, but has a higher Purchase APR and Late Payment Fee and may have different rewards.
  • If you choose to convert to the Store Card features:
    • ✓ Your access to the Secured Card features will be permanently disabled.
    • ✓ Your security deposit will be returned, minus the amount needed to pay off any: (a) existing non-promotional balance, (b) expiring (within 2 months) deferred interest promotional balances and required payment due on an equal monthly payments balance, and (c) remaining minimum payment due on the account if not covered by (a) and (b) above
    • ✓ Synchrony Bank will provide you with a replacement card and card number to access the Store Card features. Your new card will be automatically added to your Amazon wallet.

5. Updating from the Amazon.com Store Card to the Amazon Prime Store Card or from the Amazon Secured Card to the Amazon Prime Secured Card. At the time you become both (i) a cardholder of an Amazon.com Store Card or an Amazon Secured Card and (ii) a customer with an Eligible Prime Membership, your card will automatically be updated to the Amazon Prime Store Card or Amazon Prime Secured Card, respectively. “Eligible Prime Memberships” only apply to Amazon.com accounts (and not accounts on any other affiliated websites outside the U.S.) and may include, in Amazon’s sole discretion: annual and monthly Amazon Prime subscriptions and members of their Amazon Household (excluding Amazon Prime Video and invited guests of an Amazon Prime account), Amazon Prime Fresh, Amazon Family, Amazon Prime Student and trial memberships of Amazon Prime. The Amazon Prime Store Card and Amazon Prime Secured Card are governed by the same Synchrony Bank terms and privacy policy as the Amazon.com Store Card and Amazon Secured Card, respectively. If you cease to be a customer with an Eligible Prime Membership, your Amazon Prime Store Card or Amazon Prime Secured Card, as the case may be, will be changed back to an Amazon.com Store Card or an Amazon Secured Card, respectively, without any change to the set of features applicable to your account.

6. Important information about your benefits and offers. To view or adjust your default option between % back (if available), special financing (if available) or equal monthly payments, visit www.amazon.com/storecard (for Amazon Store Card accounts or Secured Card accounts that have converted to the Store Card features) or www.amazon.com/securedcard (for Secured Card accounts that have not converted to the Store Card features), sign in to ‘Your Account’ (if not already signed in), and select the radio button for your desired option. Your default option will also be applied to your 1-Click orders and purchases made at physical Amazon locations. If your default option is special financing or equal monthly payments and neither is available for a specific purchase, then (if available) the applicable % back benefit, if any, will apply. The % back benefit cannot be combined with any special financing or equal monthly payments offer. You will have the option to apply the applicable % back benefit (if available) or the longest available equal monthly payments or special financing offer(s) displayed during checkout to your purchase. If your default benefit is equal monthly payments or special financing, and multiple equal monthly payments or special financing offers are available for a specific purchase, the equal monthly payments or special financing offer, as applicable, with the longest available promotion length will apply. We may, from time to time at our discretion, supplement the % back benefit by offering bonus rewards points for certain purchases. In such cases, the total rewards points offered for such purchases will be noted on the relevant product page or during checkout, and this section will apply to the % back benefit inclusive of any bonus rewards points. The % back benefit cannot be combined with any special financing or equal monthly payments offer; you will have the option to apply either (a) any available special financing or equal monthly payments offer or (b) the % back benefit, but not both, to your purchase. If no selection is made during the checkout process, your default option will be applied to your purchase, provided such default option is available. The % back benefit is the default option for all purchases of less than $150. We reserve the right to remove any person from the % back benefit in the event of any fraud or abuse in connection with the benefit. 8. Rewards Points and Redemption. You may see rewards points referred to simply as rewards and reflected as a dollar balance (versus a points balance), with $1 of rewards being equivalent to 1 rewards point. Alternatively, you may also elect to either (a) redeem your rewards points as a one-time statement credit or (b) automatically redeem your available rewards points balance as a statement credit at the end of each subsequent billing cycle, in each case by visiting your Synchrony Bank online account management page (www.syncbank.com/amazon) or by directly contacting Synchrony Bank. Your Amazon Store Card or Secured Card account must be open and in good standing to redeem rewards points and at the time any statement credit is posted to that account. If your Amazon Store Card or Secured Card account is closed, you will forfeit any unredeemed rewards points. Please allow up to two billing cycles (a) for your earned rewards points to be credited to your Amazon Store Card or Secured Card account and (b) if you elect to redeem your rewards points as a statement credit, for such statement credit to be applied to your Amazon Store Card or Secured Card account. If any of the products related to your original order are returned, subject to Amazon’s returns and refunds policies, you will receive any refund due to you by first refunding the amount charged to your card and, if any refund is still due, then by the return of rewards points. If a refund of your rewards points cannot be processed by Synchrony Bank for reasons including, but not limited to, closure of your Amazon Store Card or Secured Card account, then Amazon will issue an Amazon Gift Card to you for an amount equal to the value of the rewards points used towards your returned purchase. 9. SPECIAL FINANCING AND EQUAL MONTHLY PAYMENTS: These offers are subject to credit approval.

  • For Amazon Store Card accounts and Secured Card accounts that have converted to the Store Card features: The standard variable purchase APR is 25.99% and is accurate as of 01/15/2021 and will vary with the market based on the Prime Rate (as defined in your credit card agreement). Minimum interest charge is $1.50.
  • For Secured Card accounts that have not converted to the Store Card features: The standard purchase APR is 10%. Minimum interest charge is $1.50.

Existing cardholders should see their credit card agreement for their applicable terms. We reserve the right to make special financing and/or equal monthly payments unavailable on any purchase at any time in our sole discretion; in such cases, and if special financing and/or equal monthly payments would otherwise have been available, we will notify you of such unavailability prior to or during checkout. Payment Schedule

The third round of Economic Impact Payments are being sent in phases.

Each week we're sending the third round of Economic Impact Payments to eligible individuals as we continue to process tax returns. If you haven't received a payment yet, it doesn't mean you won't.

Payments are sent by direct deposit or mail as a check or debit card.

We are mailing IRS Notice 1444-C to people who received a third Economic Impact Payment.

Plus-Up Payments

Plus-up payments are additional payments we are sending to people who:

  • Already received a third Economic Impact Payment based on a 2019 tax return or information received from SSA, RRB or VA
  • May be eligible for a larger amount based on their 2020 tax return

We'll automatically evaluate your eligibility for a plus-up payment using your 2020 return.

The IRS is working with federal agencies to get updated information for recipients to ensure we are sending automatic payments to as many people as possible. More information about when these payments will be made is provided in the March 30 news release and the April 14 news release.

Amount and Status of Your Payment

To find the amount of the third payment, create or view your online account or refer to IRS Notice 1444-C, which we mailed after sending the payment.

If you are sent a plus-up Economic Impact Payment after your 2020 tax return is processed:

  • The amount of your initial third payment will no longer show in your online account. You will only see the amount of your plus-up payment.
  • The status of your initial third payment will no longer show in Get My Payment. You will only see the status of your plus-up payment.

Status Messages

You'll see one of these messages when you use Get My Payment:

  • Your payment has been scheduled and it will be sent on the date shown by direct deposit or mail. If your payment is by mail, you will receive a debit card or a check. The amount of your third Economic Impact Payment is not shown.

  • You’re eligible, but a payment has not been processed and a payment date isn’t available yet.

First and Second Payment Status

The first and second Economic Impact Payments no longer appear in Get My Payment.

To find the amounts of these payments, view or create your online account. You can also refer to Notice 1444 for the first payment and Notice 1444-B for the second payment. The IRS mailed these notices to your address of record.

Didn't Get the First and Second Payments? Claim the 2020 Recovery Rebate Credit.

If you didn't get a first and second Economic Impact Payment or got less than the full amount, you may be eligible to claim the 2020 Recovery Rebate Credit and must file a 2020 tax return, even if you aren't required to file.

The third Economic Impact Payment will not be used to calculate the 2020 Recovery Rebate Credit.

Report: Consumer Protection

Addendum: After publication of this report, it came to our attention that the dataset we used to approximate the size of credit card companies relative to each other—‘purchase volume’—was incomplete. The dataset omitted information on certain cards that companies issue on behalf of other entities, such as the cards GE Capital Cost of cashiers check at bank of america issues on behalf of some department stores. This omission affects several companies, and would tend to increase those companies’ complaint rates relative to companies that are less involved in such arrangements (see chart on p. 15). Although we are unable to verify this information, a representative from GE Capital has stated that a more complete figure for their total purchase volume would change their complaints per billion dollars in purchase volume from 88 to 17 or 18, placing them in the middle of the rankings rather than at the top.

The Consumer Financial Protection Bureau (CFPB) was established in 2010 in the wake of the worst financial crisis in decades. Its mission is to identify dangerous and unfair financial practices, to educate consumers about these practices, and to regulate the financial institutions that perpetuate them.

To help accomplish these goals, the CFPB has created and made available to the public the Consumer Complaint Database. The database tracks complaints made by consumers to the CFPB and how they are resolved. The Consumer Complaint Database enables the CFPB to identify financial practices that threaten to harm consumers and enables the public to evaluate both the performance of the financial industry and of the CFPB.

This is the fourth in a series of reports that review complaints to the CFPB nationally and on a state-by-state level. In this report we explore consumer complaints about credit cards with the aim of uncovering patterns in the problems consumers are experiencing with their credit cards and documenting the role of the CFPB in helping consumers successfully resolve their complaints.

Despite the benefits to consumers brought by enactment of the Credit Card Accountability Responsibility and Disclosure (Credit CARD) Act of 2009, consumer complaints about credit cards remain common. Between November 2011 – when the Consumer Financial Protection Bureau began recording data on credit cards – and September 10th, 2013, the CFPB recorded more than 25,000 complaints about credit cards.

  • Capital One was the most complained-about credit card issuer by total number of complaints, followed by Citibank, Bank of America and JPMorgan Chase.
  • GE Capital Retail was the most complained-about credit card company among the top 10 card issuers based on the ratio of complaints to card purchase volume. GE Capital Retail experienced 88 complaints per billion dollars in purchase volume, followed by Capital One with 46 complaints and Barclays with 25 complaints per billion dollars in purchase volume.
  • Ten U.S. credit card companies accounted for about 93 percent of all consumer complaints to the CFPB. (See Figure ES-1.)

Consumers face a wide array of problems with ge capital retail bank prepaid cards credit cards. The most common problem faced by consumers was billing disputes, followed by difficulties with annual percentage rates (APR) or interest rates, and trouble with identity theft, fraud or embezzlement. Thousands of consumers also complained about problems with closing or canceling accounts, late fees and collection practices.

Complaints about companies vary by state, and state residents vary in their tendency to reach out to the CFPB.

  • Capital One was the most complained-about credit card company in 43 states, while Citibank was the most complained-about company in six states and the District of Columbia. Bank of America was the most complained-about company in Alaska. (See Figure ES-3.)
  • Residents of Northeastern states are most likely to complain about their credit cards, while consumers in the Midwest and South are least likely. The District of Columbia had the most complaints per capita, followed by Delaware, Maryland, New York, New Jersey, Florida, Connecticut, Massachusetts, Virginia and Maine.

The CFPB is making a significant difference for consumers facing difficulty with their credit card companies:

  • The CFPB has helped more than 7,300 consumers – about three in 10 complainants – to receive monetary compensation as a result of their credit card complaints. (See Figure ES-5.) The median amount of monetary relief for consumers with credit card complaints through mid-2013 was $128. More than 2,000 additional consumers have had their complaints closed with some form of non-monetary relief, which includes actions such as altering account terms or fixing an incorrect submission of information to a credit bureau.

  • Credit card companies vary greatly in the degree to which they respond to consumer complaints with offers of monetary relief. Nearly two out of every five complaints concerning GE Capital Retail resulted in monetary relief to the consumer, while only about 20 percent of complaints concerning American Express did.
  • About 20 percent of responses from credit card companies were deemed unsatisfactory by consumers and were subjected to further dispute.
  • Of the 10 companies with the most overall complaints, the company with the highest number of disputed responses was Capital One, with 1,044, followed by Citibank and Bank of America. (See Table ES-1.) These three credit card companies were also the three companies with the highest number of overall complaints.

  • Of the 10 companies with the most overall complaints, the company with phone number santander customer service greatest proportion of disputed responses was American Express (Amex), with just over a quarter of responses disputed. Of these same companies, GE Capital Retail had the lowest proportion of disputed responses, at 14 percent.

The Consumer Financial Protection Bureau’s Consumer Complaint Database is a key resource for consumer protection. To enhance the ability of the CFPB to respond to consumer complaints, the CFPB should:

  • Add more detailed information to the database, such as actual complaint narratives, detailed complaint categories and subcategories, complaint resolution details, consumer dispute details, and data regarding membership in classes protected from discrimination by law. Expansion of complaint-level details should include more information about amounts and types of monetary and non-monetary relief. Software and other techniques should be used to protect consumer privacy by chemical bank 401k login consumers the right not to provide details and by taking steps to prevent the release of personally-identifiable information or the re-identification of consumers. It is critical that the Bureau achieve the disclosure of more individual complaint details while simultaneously making every reasonable effort to protect personal data.
  • Add features such as clear definitions of terms and instructions.
  • Provide regular trend analyses and monthly detailed reports on complaint resolutions and disputes.
  • Simplify the interfaces that allow users to summarize complaint database reports in graphical and printable formats.
  • Publicize information about the CFPB complaints process in forums that are likely to be seen by credit card users. The agency should develop more outreach mechanisms for consumer education about the database and its services for consumers, including through the creation of educational materials to be distributed on- and off-line, through more events outside Washington, D.C., and through non-profit organizations.
  • Develop free applications (apps) for consumers to download to smartphones to access information about how to complain about a firm and how to review complaints in the database.
  • Expand the Consumer Complaint Database to include discrete complaint categories for high-cost credit products such as auto title loans and prepaid cards. We commend the CFPB for adding payday loan complaints to the database in November 2013.
  • Continue to use the information gathered from the Consumer Complaint Database, from supervisory and examination findings, and from other sources to require a high, uniform level of consumer protection and ensure that responsible industry players can better compete with those who are using harmful practices.

Green Dot to Buy Wal-Mart Prepaid Business from GE

Green Dot (GDOT) has agreed to acquire the Wal-Mart-branded prepaid card business from GE Capital Retail Bank.

Green Dot Bank will acquire the deposits underlying the Wal-Mart MoneyCard program from GE at par and will issue future deposits on the cards, it said in a filing with the Securities and Exchange Commission on Monday. The deal is expected to close in the second half of the year, pending regulatory approval.

The filing did not disclose the dollar amount of the deposits or the consideration paid to GE, if any. Both Wal-Mart and GE Bank agreed to the change. Green Dot will issue the Wal-Mart cards through May 2015, it said.

Green Dot had been service provider and program manager of the Wal-Mart prepaid cards, with GE Bank serving as the issuing bank, since the cards were introduced in ge capital retail bank prepaid cards. Making Green Dot the issuer will exempt the cards from interchange-fee cap proposed by the Durbin Amendment, which limits fees for prepaid cards issued by banks with more than $10 billion of assets, according to a research report from Janney Capital Markets analyst Thomas McCrohan. The Provo, Utah-based Green Dot Bank has $389 million of assets; GE Capital Retail Bank in Draper, Utah, has approximately $34 billion of assets.

GE Capital is "focused on its core business model of providing nags head cottage rentals credit through retailer and dealer relationships" and "believes that the Wal-Mart MoneyCard program can best achieve its full potential" with Green Dot as the issuer, it said in the filing.

Payment Schedule

The third round of Economic Impact Ge capital retail bank prepaid cards are being sent in phases.

Each week we're sending the third round of Economic Impact Payments to eligible individuals as we continue to process tax returns. If you haven't received a payment yet, it doesn't mean you won't.

Payments are sent by direct deposit or mail as a check or debit card.

We are mailing IRS Notice 1444-C to people who received a third Economic Impact Payment.

Plus-Up Payments

Plus-up payments are additional payments we are sending to people who:

  • Already received a third Economic Impact Payment based on a 2019 tax return or information received from SSA, RRB or VA
  • May be eligible for a larger amount based on their 2020 tax return

We'll automatically evaluate your eligibility for a plus-up payment using your 2020 return.

The IRS is working with federal agencies to get updated information for recipients to ensure we are sending automatic payments to as many people as possible. More information about when these payments will be made is provided in the March 30 news release and the April 14 news release.

Amount and Status of Your Payment

To find the amount of the third payment, create or view your online account or refer to IRS Notice 1444-C, which we mailed after sending the payment.

If you are sent a plus-up Economic Impact Payment after your 2020 tax return is processed:

  • The amount of your initial third payment will no longer show in your online account. You will only see the amount of your plus-up payment.
  • The status of your initial third payment will no longer show in Get My Payment. You will only see the status of your plus-up payment.

Status Messages

You'll see one of these messages when you use Get My Payment:

  • Your payment has been scheduled and it will be sent on the date shown by direct deposit or mail. If your payment is by mail, you will receive a debit card or a check. The amount of your third Economic Impact Payment is not shown.

or

  • You’re eligible, but a payment ge capital retail bank prepaid cards not been processed and a payment date isn’t available yet.

First and Second Payment Status

The first and second Economic Impact Payments no longer appear in Get My Payment.

To find the amounts of these payments, view or create your online account. You can also refer to Notice 1444 for the first payment and Notice 1444-B for the second payment. The IRS mailed these notices to your address of record.

Didn't Get the First and Second Payments? Claim the 2020 Recovery Rebate Credit.

If you didn't get a first and second Economic Impact Payment or got less than the full amount, you may be eligible to claim the 2020 Recovery Rebate Credit and must file a 2020 tax return, even if you aren't required to file.

The third Economic Impact Payment will not be used to calculate the 2020 Recovery Rebate Credit.
